Following a three-day hearing in London, Judge Robert Jay announced that no ruling would be made for the time being.

  • Massaโ€™s counsel, Nick De Marco KC, asserted the FIAโ€™s inaction violated its duty of integrity, citing Ecclestoneโ€™s 2023 admission of prior knowledge. De Marco argued annulling Singapore would have awarded Massa the championship, with viable prospects for success.
  • FIAโ€™s John Mehrzad KC countered that Massaโ€™s pit stop error (jammed fuel hose) and Ferrariโ€™s strategy caused his 13th-place finish, not Crashgate. He emphasized Hamiltonโ€™s season-long superiority and the claimโ€™s untimeliness.
  • FOMโ€™s Anneliese Day KC and Ecclestoneโ€™s David Quest KC echoed delay and causation issues, noting Massa did not pursue legal action earlier despite 2009 revelations. Quest dismissed Ecclestoneโ€™s interview as unreliable memory.

U.S. District Judge Kenneth Bell ruled โ€œin favor ofโ€ 23XI and FRM โ€œon an argument over the market definition of โ€˜premier stock-car racing.โ€™โ€ Bell found that NASCAR โ€œcontrols the marketโ€ and NASCARโ€™s argument that teams can race in other series โ€œis moot.โ€ Bell found โ€œNASCAR deliberate(ly), clear(ly) and unambiguous(ly)โ€ alleged that the relevant market is โ€œthe market for entry of cars into NASCAR Cup Series races in the United States and any other location where a Cup Series race is heldโ€
